| Other information | ASSAULT CONVICTION In March 2008 while he was celebrating his inclusion into the 2008 Olympic team he got into an argument with retired Australian swimmer Simon Cowley outside a bar in Sydney. D'Arcy punched Cowley in the face, breaking his nose, jaw and eye socket. He was charged with inflicting grievous bodily harm and in April 2008 the Australian Olympic Committee [AOC] dropped D'Arcy from the 2008 Olympic team. D'Arcy appealed the decision to the Court of Arbitration for Sport, but the original decision was upheld and D'Arcy did not compete in Beijing. In March 2009 he was given a 14-month suspended jail sentence and was later dropped from Australia's team for the 2009 World Championships. In July 2011 a judge awarded Cowley $180,00 Australian dollars in damages for the injuries he received. After D'Arcy filed for bankruptcy in December 2011 there was the chance he may have been ineligible to compete in London, but both Swimming Australia and the AOC supported his nomination in March 2012 (abc.net.au, 30 Mar 2009, smh.com.au, 27 Mar 2009; smh, 22 Feb 2012) ASTHMA MEDICATION In March 2010 an out-of-competition test returned a positive result for Formoterol, an asthma medication that swimmers need permission from FINA to use. At the time of the test, D'Arcy had not been granted permission by FINA. D'Arcy had applied for exemption in November 2009 but FINA had requested more information be sent with his application. When the positive test revealed he had not received the proper permission, Swimming Australia forwarded the documents again and FINA backdated the application. (theaustralian.com.au, 06 Sep 2010) HATE MAIL AND DEATH THREATS His coach Bohl said that he and the swimmer have been subjected to weekly personal attacks through mail posted to the Brisbane college where D'Arcy trains. Also, a man was charged in June 2012 with making written threats to murder D'Arcy and stalking him and his parents.
